These Terms of Service ("Terms") form a binding agreement between you and ARCADA LLC, a Delaware limited liability company ("Polyterminus," "we," "us"), and govern your use of the Polyterminus software service accessed at polyterminus.com, app.polyterminus.com, and any related surfaces (together, the "Service").
1. What Polyterminus is (and is not)
Polyterminus is an independent third-party software interface for trading on Polymarket. We are not affiliated with, endorsed by, or operated by Polymarket. We do not custody your funds, we do not execute trades as principal, and we do not provide financial, investment, tax, or legal advice.
All prediction-market trading takes place on Polymarket infrastructure with your own Polymarket account. Polymarket's own terms, geographic restrictions, and market resolution rules govern the underlying trading. If Polymarket is unavailable to you, so is the Polyterminus trading surface.
2. Eligibility
You may use the Service only if you: (a) are at least 18 years old; (b) have full legal capacity to enter into these Terms; (c) are located in a jurisdiction where Polymarket permits trading; and (d) are not on any sanctions list maintained by OFAC, the EU, the UK, or the UN.
3. Account and credentials
You are solely responsible for maintaining the confidentiality of your login and any Polymarket signer keys you paste into the Service. We store signer credentials encrypted at rest (AES-256-GCM, key held in Google Secret Manager). We never see plaintext credentials, and we never gain the ability to withdraw funds from your Polymarket wallet.
4. Non-custodial nature
Polyterminus is non-custodial. We do not hold, control, or have access to your funds. Every order placed through the Service is signed by your own credentials and submitted directly to Polymarket. If the Service becomes unavailable, your funds and positions remain on Polymarket and are unaffected.
5. Risk gate and automation
The Service includes optional risk-management tooling (daily loss limits, take-profit / stop-loss orders, AI agents, copy-trading autopilot). These are provided as-is. You are solely responsible for configuring them appropriately for your risk tolerance. We do not guarantee any specific execution outcome, latency, or profitability. Automated features can, and sometimes will, fail — always monitor open positions.
6. Fees
The Free plan is offered at no charge. Paid plans (Pro, Founder) are billed monthly or annually as displayed at signup. Polymarket's own trading fees apply separately and are collected by Polymarket, not us.
7. Prohibited use
- Circumventing Polymarket's geographic or KYC restrictions.
- Attempting to manipulate prediction-market prices (spoofing, wash trading, layering).
- Reverse-engineering, scraping, or resharing the Service beyond fair-use limits.
- Using the Service to launder funds, evade sanctions, or finance illegal activity.
- Uploading malware, spamming other users, or interfering with Service infrastructure.
8. Intellectual property
All software, documentation, branding, and content on the Service are owned by ARCADA LLC or its licensors. You are granted a limited, non-exclusive, revocable license to use the Service for its intended purpose. Public prediction-market data displayed within the Service is sourced from Polymarket's public APIs and is owned by Polymarket.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT THE SERVICE WILL BE SECURE OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCADA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, TRADING LOSSES, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) US $100.
11. Indemnification
You agree to indemnify and hold harmless ARCADA LLC from any claim, loss, or expense arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
12. Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including if you breach these Terms or if we reasonably believe your account is used in violation of law. You may stop using the Service at any time.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of these Terms shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware. You waive any objection to personal jurisdiction or venue in those courts.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or via in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
